School Zone Speed Enforcement Program

The Town of Loxahatchee Groves is working to improve community safety by installing state-of-the-art digital speed safety cameras to decrease traffic violations and collisions and to help increase safety around our local schools. The Town has partnered with Red Speed® USA, a global technology group, to use speed safety cameras in the school zone at Loxahatchee Groves Elementary School to protect students from reckless drivers. Speed safety cameras are proven to be effective in reducing crashes as well as pedestrian-related injuries. Communities that use speed safety cameras consistently report safer roads around their schools. Our school zone speed safety program helps drivers pay more attention and obey traffic laws. This is just one of the many tools the Town of Loxahatchee Groves is employing to speeding, eliminate traffic fatalities, and keep the community safe.

What is the School Zone Camera Safety Program?

House Bill 657, signed into law by Governor Ron DeSantis on May 31, 2023, allows for the use of cameras to enforce speed limits in school zones throughout the entire school day. What does “photo-enforced” mean?

A Notice of Violation will be issued to the registered vehicle owner if the vehicle is recorded traveling  11 miles or more per hour over the posted speed limit. This notice will include the date, time, and location of the violation, along with photographic evidence captured at the time of the offense. Image

When and where is photo enforcement used?

The camera enforcement system will operate throughout the entire school day, with specific activation times based on each school's schedule. Speed enforcement will be in effect during the following time periods:

  • 7:02 AM - 8:09 AM - Speed Limit is 15 MPH

  • 1:46 PM - 2:35 PM - Speed Limit is 15 MPH

How are School Zone Speed Limits Determined in Loxahatchee Groves?

These limits are not set by the Town, but rather by Florida law.

The Florida Legislature passed Florida Statute 316.1895, “Establishment of School Speed Zones, Enforcement; Designation.” This statute requires the Florida Department of Transportation (FDOT) to adopt and maintain a uniform system of traffic and pedestrian control devices around all public and private schools in the state. Counties and municipalities are required to follow these standards.

The FDOT has published a manual titled “Speed Zoning for Highways, Roads and Streets in Florida.” Within this manual:

  • For roads with posted speeds of 35 mph or higher, the school zone speed limit must be 20 mph.

  • For roads with posted speeds of less than 35 mph, the school zone speed limit must be 15 mph, except as otherwise provided in Florida Statute 316.1895.

Before implementing the School Zone Speed Enforcement Program, the Town of Loxahatchee Groves consulted with Palm Beach County and the Indian Trails Improvement District to ensure that all signage matched countywide standards and that the program complied with all applicable state laws and requirements.

What data are the cameras capturing and is that information secure?

The camera enforcement systems are configured to collect data as directed by the Town of Loxahatchee Groves, in accordance with local, state, and federal regulations. Captured data includes still images of the vehicle and its license plate, along with the date, time, location, and recorded speed.

All information is encrypted and securely transmitted to a central server, where it is digitally signed to protect against tampering or unauthorized access. Original images and associated data are safely stored in a secure data vault to maintain the integrity of the evidence chain.

How much does the photo enforcement program cost taxpayers?

The photo enforcement system is fully financed through revenue generated from issued violations. 

Who issues the Notice of Violation?

Only a State of Florida traffic infraction enforcement officer, employed by the Palm Beach County Sheriff’s Office, is authorized to issue a Notice of Violation. 

What are my options if I receive a notice of violation?

The registered owner of the vehicle has two options upon receiving a Notice of Violation:

  1. Pay the fine within 30 days of the notice date, or
  2. Request a hearing within the same 30-day period.
  • If no action is taken within 30 days, a Florida Uniform Traffic Citation will be issued.
  • Resolving the violation during the Notice of Violation stage will not impact the driver’s license, vehicle registration, or insurance.
  • Complete instructions and options will be provided in the Notice of Violation sent to the registered owner.

Will paying a Notice of Violation affect my insurance or driver’s license? 

No, a Notice of Violation is a civil matter and does not impact your driving record, license status, or insurance rates.

Who Gets How Much From Each Speeding Ticket

Here is the breakdown of where the $100 from each ticket goes once it’s paid, according to Florida State Statute 316.1896. 

  • $20 to the Florida Department of Revenue’s General Fund
  • $21 to Red Speed to administer speed detection systems in school zones.
  • $39 to the Town for various public safety initiatives
  • $3 to the Florida Department of Revenue for deposit into the department of law-enforcement criminal justice standards in training trust fund.
  • $12 goes to the county school district in which the violation occurred and must be used for school security initiatives, student transportation, or to improve the safety of student walking conditions. Funds from this amount of money must also be shared with charter schools based on a formula.
  • $5 goes to the Palm Beach County Sheriff's Office for School crossing guards’ recruitment and retention programs

What happens if I am the registered owner but someone else was driving the motor vehicle?

The registered owner of the vehicle is responsible for paying the Notice of Violation unless they provide a written affidavit demonstrating one of the following:

  • At the time of the violation, the vehicle was under the care, custody, or control of another individual.
  • The driver received a traffic citation from a law enforcement officer for the same alleged violation.
